April 8, 2008 Ottawa, Tuesday April 8, 2008 – The International Fund for Animal Welfare (IFAW), the Canadian Federation of Humane Societies (CFHS) and the World Society for the Protection of Animals (WSPA) launched the website www.dontbecruel.org or www.dontbecruel.ca today. The website’s purpose is to highlight the position of voting MPs on animal cruelty and to hold them accountable for it. On Wednesday April 9th, MPs will participate in a recorded vote on Bill S-203. If the bill passes it will be sent for Royal Assent and then become a law. Animal welfare groups from across the country as well as the strong majority of Canadians oppose this legislation, going so far as to say that a vote for Bill S-203 is a “vote for animal cruelty” as it fails to address the loopholes in the current law which allow animal abuse to go unpunished. On the www.dontbecruel.org or www.dontbecruel.ca site, the names of MPs who voted for and against the bill will be listed. “This is a chance for Canadians to see if politicians are listening to their constituents. We have explained many times why Bill S-203 is an ineffective piece of legislation and why Canadians are opposed to it. With this website, we intend to show Canadians which politicians have listened and which have not,” stated Shelagh MacDonald, Program Director of the Canadian Federation of Humane Societies. S-203 increases penalties but does nothing to fix the serious problems in the offences. “S-203 is not based on broad consultation, it doesn’t address the flaws in the current law and, not surprisingly, it is not widely supported in this country. Canadians expect modern legislation to protect animals from criminal cruelty – not a quick fix to a law that was passed in Queen Victoria’s era” reinforced Kim Elmslie from the International Fund for Animal Welfare. “MPs who voted in favor of S-203 have turned their back on all those Canadians who said they want and expect strong and effective laws for the prevention of cruelty to animals. Eight years of work towards a new animal cruelty law cannot end with S-203! Clearly, MPs who vote for S-203 are choosing the lazy way out. Unfortunately, it’s the animals that will pay the price as this legislation does nothing to improve the chance of convicting animal abusers,” said Melissa Tkachyk, Programs Officer for the World Society for the Protection of Animals. Vote on Bill S-203 will happen on Wednesday April 9th, at 17h30. Names and positions of the MPs will be published on the www.dontbecruel.org or www.dontbecruel.ca within 24 hours of the vote. The bill is opposed by the vast majority of Canadians and every animal protection group in the country. “Humane societies and SPCAs across Canada are shocked and dismayed that Parliament has ignored our calls for strong and effective animal cruelty legislation. It is extremely disappointing that almost ten years of debate have only produced this, a bill that will still allow the vast majority of animal abusers to escape punishment,” said Shelagh MacDonald of CFHS, representing SPCAs and humane societies across the country. “Our agents and inspectors will continue to be handcuffed by inadequate legislation that does nothing to improve protection for animals from cruelty and abuse.” While the groups welcome increased penalties for animal cruelty crimes, they maintain this bill will only apply to less than 1% of animal abusers as that is how many can be successfully convicted under the Criminal Code today. Bill S-203 continues to make it nearly impossible to punish crimes of neglect and does not criminalize the breeding and training of animals to fight each other. “MPs are out of date, out of step and out of touch with the expectations of Canadians today,” stated IFAW campaigner Kim Elmslie. “Canada is falling behind countries such as Malaysia, the Philippines and the Ukraine in protecting our animals from cruelty.” More than 130,000 Canadians signed petitions specifically opposing Bill S-203. A 2006 poll found 85% of Canadians want modern and effective legislation that makes it easier for law enforcement agencies to prosecute those who commit criminal acts of animal cruelty. Stated Pat Tohill, WSPA Programs Manager: “During the debate, many MPs argued that S-203 was only a first step. Many said they would support MP Mark Holland’s Bill C-373. Most said they would support further amendments to Canada’s animal cruelty laws. We will be holding MPs to their commitment to support further amendments to Canada’s cruelty laws. Canadians will not wait another century before animals are protected from heinous acts of cruelty in Canada.” A more comprehensive animal cruelty bill has been passed by Canada’s House of Commons twice in the past ten years, receiving the support of all political parties only to die in the Senate. The CFHS, IFAW and WSPA plan to continue their fight for long-overdue and reasonable amendments to Canada’s Victorian-era animal cruelty law. Canadians expect nothing less. Caro18 0 Posté(e) le 10 avril 2008 Un projet de loi contre la cruauté envers les animaux déplaît aux animalistes Le 9 avril 2008 - 19:17 | L'approbation aux Communes des premiers changements importants en plus d'un siècle aux lois canadiennes contre la cruauté envers les animaux n'a pas fait le bonheur des amis des bêtes. Un projet de loi d'initiative parlementaire, déposé par le sénateur libéral John Bryden, a été approuvé par 189 voix contre 71, mercredi, obtenant l'appui de la majorité des députés conservateurs et bloquistes et de plusieurs libéraux. Le projet de loi propose des peines plus sévères dans les cas de cruauté envers les animaux. Il a déjà été approuvé par le Sénat et deviendra une loi lorsqu'il aura reçu la sanction royale. C'est fait! Plusieurs groupes de défense des droits des animaux, dont la Fédération des sociétés canadiennes d'assistance aux animaux, s'opposent au projet de loi, qui ne serait qu'une mise à jour d'une mauvaise loi. Ils soutiennent plutôt un autre projet de loi, déposé par le député libéral Mark Holland. NDP MPs voted against this legislation and share the deep disappointment of all who fought hard against S-203. Le 9 avril, 189 députés ont voté en faveur du passage du projet de loi S-203 en dépit d'une forte opposition de tous les groupes de protection des animaux. Notre campagne pour l'efficacité de la législation fédérale pour protéger les animaux est loin d'être terminée. Dans un premier temps, il nous faut remercier les députés qui ont voté contre le projet de loi S-203 et de les encourager à travailler avec nous pour arriver à une meilleure loi. Si votre député a voté pour le projet de loi S-203, dites-leur comment vous êtes déçus de ne pas représenter votre point de vue au Parlement. Les médias ont rapporté un nombre effarant de cas de cruauté animale, incluant l’histoire d’un pauvre chat tué dans un micro-onde, d’un chiot battu à mort à coups de marteau sur le crâne ainsi que le cas de ces 29 chevaux quasi morts après avoir souffert de grave négligence alors que 100 autres nécessitaient des soins médicaux d’urgence. 2008 n’a pas non plus été une bonne année pour la démocratie. Malgré le message clair que nous communiquons aux députés depuis les neuf dernières années, nos élus ont appuyé le projet de loi S-203, malgré l’opposition généralisée des canadiens. S-203 permet aux abuseurs d’animaux de circuler en toute liberté S-203 permet la cruauté envers les animaux sauvages, errants et abandonnés S-203 permet quasiment l’impunité des crimes de négligence S-203 permet la cruelle réalité d’élever et d’entraîner des chiens pour les combats Votre *député a-t’il voté pour mettre un terme à la cruauté envers les animaux ? Découvrez si votre député a voté en faveur du projet de loi S-203 ou s’il s’y est opposé en visitant le www.dontbecruel.ca (site bilingue). L’IFAW a récemment publié un rapport comparant la législation canadienne en matière de cruauté animale avec celles mises en place dans 13 autres pays du monde. La législation canadienne ne comporte pas de définition claire du terme « animal » alors que les autres pays sont explicites. Le Canada est le seul pays qui n’offre pas de protection aux animaux qui sont entraînés pour se battre entre eux. Le Canada est le seul pays qui rend la poursuite de cas de négligence pratiquement impossible. La loi S-203 n’améliore nullement les lois régissant la cruauté animale et ne fait rien non plus pour les rendre pertinentes sur la scène internationale. De plus, S-203 va à l’encontre de la volonté des Canadiennes et Canadiens. Il est temps que nos députés soient redevables à la population canadienne.
