A total 174 pet owners launched a class action Monday against a local
importer of dog food for damages to their pets caused by allegedly tainted
dog food.

The suit is seeking 1.2 billion won (US$ 1.19 million) in compensation
through the Seoul District Court for pets that allegedly died or continue to
suffer from acute renal failure after being fed with `Pedigree' tainted by
fungous growth imported by Master Foods Korea.

Master Foods Korea is a subsidiary of Mars Inc., which sells not only dog
feed but also Snickers and Mars chocolate bars.

"As Master Foods Korea failed to deal adequately with the tainted dog food
by using a voluntary recall as its excuse, even though Taiwan had already
seen a disease outbreak because of the polluted feed, we have suffered,"
they said.

"According to the product liability law, the importer has the same
responsibility as the manufacturer," the claimants added.

"As we have apologized to customers and provided compensation to individuals
since announcing the recall on the dog food in March, 2003, it is better for
them to contact us directly rather than depending upon a legal suit," the
importer said in a statement.

L'incident remonte à il y a déja deux ans. J'imagine qu'ils ont des preuves à l'appui pour se lancer dans une poursuite.

Sur le site de T.Lonsdale j'ai vu qui'il est en train de réunir des cas pour une *class action* devant un tribunal des Etats-Unis. J'ignore à quel stade la procédure se trouve actuellement.

Je ne crois pas que T.Lonsdale va faire les choses *à moitié*.

Et je suppose que les les sommes en dédomagement atteignant souvent au tribunaux USA des hauteurs stratosphériques ne seront pas forcément au gout des actionnaires, craignant des pertes sur leur shareholder values.
